By participating in IAIMS Affiliate internet marketing program (the "Program"), You agree with the supplemental Program terms and conditions set forth below, established by IAIMS, Inc. ("IAIMS").
In consideration for participating in the Program, You agree to the following terms:
1) Spam.
Under no circumstances shall You send commercial electronic mail messages as defined in the CAN-SPAM Act of 2003 [the "Act"] with respect to IAIMS Program. For clarification, this does not prohibit You from sending transactional or relationship messages as defined in the Act. IAIMS reserves the right to collect, withhold, or cancel any and all compensation related to the content You send via commercial electronic mail messages.2) Tracking Tags.
The creative products and creative assets (collectively, "Assets") - including information technology that helps make sure transactions generated by you are properly attributed to you for payout calculations and valuable information vital to the success of the Program - are provided to you by IAIMS, Inc. Thus, each of these Assets must be used in their intended manners as instructed by IAIMS. You agree that You will not corrupt, modify or disable the tracking functionality provided to You related to the Program.3) Keywords, Pay Per Click advertising, and domain names involving IAIMS trademark "IAIMS" and variations thereof.
You shall not purchase search engine keywords or domain names that use IAIMS trademark "IAIMS", "Insurance Agent Internet Marketing Systems", and/or certain variations and mispellings thereof. You shall not purchase or register keywords, Pay Per Click advertising, AdWords, search terms, domain names, or other identifying terms that include the word "IAIMS", "Insurance Agent Internet Marketing Systems", or certain variations and mispellings thereof for use in any search engine, portal, sponsored advertising service or other search or referral service. Specifically, this policy prohibits You from:* Bidding on IAIMS trademark, "IAIMS" or Insurance Agent Internet Marketing Systems"; and
* Bidding on variations of IAIMS trademark or Insurance Agent Internet Marketing Systems";
* Purchasing domain names based on IAIMS trademarks, "Insurance Agent Internet Marketing Systems", and/or variations of IAIMS trademark; and
* Purchasing Pay Per Click advertising containing IAIMS trademarks, "Insurance Agent Internet Marketing Systems", and/or variations of IAIMS trademark.If IAIMS determines, in its sole discretion, that You have purchased or attempted to purchase "IAIMS" keywords or domain names, or one of the four cited examples above, then IAIMS may (without limiting any other remedies available to it) pursue any or all of the following actions:
* Withhold all compensation otherwise payable to You beginning with the date on which You purchased the prohibited trademarked terms;
* Remove You from the IAIMS Affiliate Program permanently; and/or
* Contact the search engine in which Your ad was found to ask that these ads be removed immediately and permanently.4) Chargebacks, 90-Day Guarantee Refunds, and Other Revenue Loss.
To protect against fraud, excessive chargebacks, and refunds against an individual affiliate account, we have instituted the following policy. In all cases where fraud, refunds, chargebacks, reversals or other revenue loss items are associated with an affiliate's account, the commission from the revenue loss item will be deducted from the affiliates commission account balance when the charge is incurred. These deductions will be noted in your account payment details. Excessive refunds or chargebacks will also be grounds for suspension of the affiliate's active status until an investigation can be completed as to the source of the issues.5) Independent Contractor Agreement.
I/we acknowledge that as an independent contractor I have the sole responsibility for the payment of my own income taxes, and am subject to the self-employment tax. I further acknowledge that it is my responsibility to provide my own insurance for injuries and/or liability coverage, since I am not engaged as an employee of IAIMS Inc. I understand that I am not eligible for any employee benefits.I herby furnish IAIMS Inc with my federal ID number or social security number and current mailing address so the company can report form 1099 Misc at the end of the year. I understand my failure to provide this may result in having 20% of my compensation withheld under the backup withholding rules.
